MSP Gil Paterson has released another statement on the matter of equal pay at West Dunbartonshire Council.
He said: “Yet again the Labour party has shown a brazen hypocrisy and a complete lack of self-awareness in a bid to fool the public and blame the new SNP administration of not dealing with the equal pay issues.
“They were in power in West Dunbartonshire for the five-year period from 2012 to 2017 when they should have dealt with the equal pay issue which was time barred before the SNP administration took over.
“The Labour party continually accuse the SNP of inaction in Government when they were instrumental in denying the Scottish Parliament the powers to deal with these issues
“Employment law is reserved to Westminster. This Westminster law the Equality Act 2010 (the Act) does not allow payments in the circumstances that some very unfortunate women in West Dunbartonshire find themselves in — that they did not submit a claim in the five-year time window from March 31 2012 to March 31 2017.
“In all the cases I have dealt with, the trade unions and the lawyers involved have been clear that they are unable to challenge the law on this matter. They must have submitted a claim during the stated five-year time period.
“However, should anyone be of the view that the council in some way has not operated or carried out the proper processes to the letter of the law then even at this late stage this is still open to challenge.
“The time bar implicit under this Westminster law does not protect any council from carrying out its functions properly.”
